Terms and Conditions of Hire
GENERAL
These terms and conditions apply to all contracts entered into by the Company unless otherwise stated in the written quotation. Revisions to quotations may be made (subject to availability) at any time up to seven days prior to the Period of Hire.
DEFINITIONS
The Company is British Marquee Company and/or their subcontractors and agents.
The Hirer is the person/persons hiring the equipment from the Company.
The Equipment is all items provided to or hired by the Hirer.
The Period of Hire is the time commencing immediately after the erection by the Company of the Equipment and terminating after the Equipment is returned by the Hirer or removed by the Company.
TERMS
The Hirer will pay a non-returnable deposit of £250.00 (Two hundred and fifty pounds) to secure any booking.
The balance of the total hire charge will be due in full ON COMMENCEMENT OF PERIOD OF HIRE.
Cancellation of booking at any time - Loss of deposit.
Cancellation of booking 7 to 28 days prior to function date - 25% of total hire charge.
Cancellation of booking less than 7 days prior to function date - 50% of total charge.
SITE CONDITIONS
The Company’s quotation is based on the assumption that the site comprises level, firm ground with reasonable access for commercial vehicles and that no cables, drains or other services are buried beneath the site or otherwise concealed. Any damage resulting thereto is the responsibility of the Hirer. Quotations for lighting and power leads are based on the assumption that a suitable and sufficient power source is available within 50 meters of the Marquee. The hire charges include any repairs or making good that may be required to the site.
HIRERS RESPONSIBILITIES
The Hirer shall agree with the Company where the Equipment is to be erected or shall have a representative on site for that purpose. In the absence of both of these, the Company will erect the Equipment where it thinks fit. The Hirer is responsible for obtaining all necessary permits or permissions that may be required. The Hirer is responsible for the safe custody of the Equipment during the period of hire and will make good to the Company any loss or damage to the Equipment other than that covered by the optional insurance or through fair wear and tear.
INSURANCE
Where taken by the Hirer this includes cover for fire, theft and damage to the Equipment but excludes damage by storm or tempest and the first £250.00 of any claim.
FIRE SAFETY
Under no circumstances shall naked flame or direct heat be used to heat or illuminate the marquee.
THIRD PARTY LIABILITY
The Company will not be held responsible for, and the Hirer will indemnify the Company against all claims for injury to person/persons or loss of /damage to any property however caused, unless it can be proved that such injury/damage resulted from faulty materials or workmanship or negligence on the part of the Company.
FORCE MAJOR
Whist every effort will be made by The Company to complete an order, the Company cannot be held liable for non-completion of orders due to matters beyond its control.
LAW
In the event of any dispute arising from any agreement entered into, this will be dealt with under the laws of England.
